These Terms of Service apply to SCADAR.NET and to any branded or white-label version of the SCADAR.NET platform operated or provided by CMC NV.  This includes, but is not limited to:
  1. Stand-alone domains such as air-insite.com, and
  2. Sub-domains or branded instances such as elgi.scadar.net.
  3. All such variants operate under the same data protection principles, policies, and governance as defined in this Privacy Policy.
SCADAR.NET Terms of Service

Welcome to SCADAR.NET, a hosted Software-as-a-Service (SaaS) platform operated by CMC NV (“we,” “us,” or “our”). SCADAR.NET is available either as a shared, tiered subscription service (e.g. Leak Guru, Auditor, Consultant, Power Consultant) or as a dedicated hosted instance under a custom subdomain (e.g. yourcompany.scadar.net) through our HOST subscription tiers.  These Terms of Service (“Terms”) govern your access to and use of SCADAR.NET in both models.  By creating an account, subscribing, or otherwise using the service, you agree to be bound by these Terms.

  • The service provides access to the SCADAR.NET platform as defined in Annex A – Service Features & Entitlements.
  • Two delivery models are offered:
    • Tiered Subscriptions (Multi-tenant)
      : shared access to the SCADAR.NET platform with functionality defined by subscription type (Leak Guru, Auditor, Consultant, Power Consultant).
    • Dedicated Host Subscriptions (Single-tenant)
      : a private, hosted instance of SCADAR.NET provided under a custom subdomain (e.g. customername.scadar.net), bundled with defined user entitlements and administrative control features.
  • Services include hosting, updates, maintenance, and support as described in Annex A.

1. Service Overview

  • SCADAR.NET is a subscription-based online platform for compressed air system auditing, monitoring, modelling, and reporting.
  • Access is provided through defined subscription tiers (e.g. Leak Guru, Auditor, Consultant, Power Consultant, Host tiers).
  • Features available in each tier are described in Annex A – Service Features & Entitlements.

2. Account Responsibilities

  • You must provide accurate and up-to-date registration and account details.
  • Access may only be used by authorised users within your organisation.
  • You are responsible for maintaining the confidentiality of account credentials and ensuring they are not shared outside of authorised users.
  • You must not misuse the service (e.g. attempting to disrupt operation, circumvent security, or gain unauthorised access).
  • For HOST subscriptions
    : the number of user accounts included in your tier is defined in Annex A. It is the responsibility of the designated HOST Administrator(s) to:
    • create, manage, and deactivate user accounts,
    • allocate roles and permissions appropriately, and
    • oversee compliance with these Terms by all users within the instance.

3. Data Ownership & Privacy

  1. You retain full ownership of all data you upload to or generate within SCADAR.NET.
  2. We process and store this data solely for the purpose of providing the service..
  3. We may use aggregated or anonymised data to improve and develop the platform, provided it cannot reasonably identify you or your organisation.
  4. As CMC NV is established in the EU, all data is processed in compliance with GDPR and UK GDPR.
  5. Where applicable, we will also comply with other regional data protection laws when providing the service to users in those jurisdictions.
  6. Our Privacy Policy provides further detail on how we collect, use, and protect personal data.


4. Service Availability

  • We target 99.5% uptime each month, excluding planned maintenance.
  • Planned maintenance will be communicated in advance where possible.
  • Service interruptions outside our control (e.g. internet outages, third-party hosting failures) may occur.

5. Support

  • Support is provided via our online portal and ticketing system.
  • Higher-tier subscriptions include extended support entitlements (see Annex A).
  • Response and resolution times are defined in our Service Level Agreement (SLA).

6. Fees & Payment

  • General Subscriptions
    • Subscription fees are charged annually in advance (unless otherwise agreed in writing).
  • HOST Subscriptions
    • HOST tiers are invoiced on 30 September each year for the following calendar year (e.g. invoice dated 30 September 2025 covers service for the 2026 calendar year).
    • This approach provides customers with ample time to arrange settlement.
    • All HOST invoices must be paid in full on or before 31 December of the same year.
    • Failure to settle by this date may result in service restrictions until payment is received.
    • When evaluating suitability for a HOST tier, we require evidence of sufficient annual consumption (typically at least 50 base stations/loggers per annum). This ensures the viability of creating and maintaining dedicated variant part numbers and software etc.
    • If actual consumption falls below this threshold, we reserve the right to apply a low consumption levy at our discretion.
  • Fees & Taxes
    • All fees are exclusive of VAT/taxes unless a valid exemption is provided.
  • Upgrade Options
    • Power Consultant licence: €895 per user, per subscription term.
    • Multi-brand asset management: €1,995 per brand, per subscription term.
  • Late Payment
    • Late payments may incur statutory interest in addition to any service restrictions.


7. Usage Quotas & Limits

  • Quotas and limits apply as defined in Annex A (e.g. audits per month, archive retrieval periods, user allocations).
  • Quotas reset at the start of each subscription term.
  • Exceeding quotas may require an upgrade or additional fees.

8. Term & Renewal

  • Subscriptions run for a defined term (typically 12 months).
  • Unless cancelled with written notice [30/60 days] before renewal, subscriptions automatically renew.
  • We may suspend or terminate accounts for non-payment, misuse, or breach of these Terms.

9. Updates & Improvements

  • We may update, enhance, or improve SCADAR.NET from time to time.
  • Core entitlements listed in Annex A will not be materially reduced during an active subscription term.
  • Material changes to pricing or terms will be communicated before renewal.

10. Liability

  • SCADAR.NET is provided “as is” and “as available.”
  • Our liability is capped at the amount you paid in subscription fees in the 12 months before a claim.
  • We are not liable for indirect or consequential losses (e.g. lost profit, production downtime).

11. Governing Law

  • These Terms are governed by Belgian law.
  • Disputes will be subject to the exclusive jurisdiction of the competent courts.

12. Annex A – Service Features & Entitlements

  • Annex A sets out the features, quotas, and upgrade options available under each subscription tier.
  • Features apply for the duration of your active subscription term.
  • Functional enhancements may be introduced at our discretion.
  • Quotas reset each subscription term.
  • In the event of conflict between Annex A and these Terms, these Terms prevail.

  • Subscriptions included per Host tier

    • Host100 = 100 Consultant users
    • Host250 = 250 Consultant users
    • Host500 = 500 Consultant users
    • Host750 = 750 Consultant users
    • Host1000 = 1,000 Consultant users
    • Host1500 = 1,500 Consultant users
  • Admin users
    • Scale with Host tier (1–5)
  • Low Consumption Levy (Equipment purchases)
    • Any Host tier: €7,495
